The Constitution Is NOT A "Negative" Document!

I know what they mean. It's the whole conservative line that the U.S. Constitution's purpose was to establish a limited government. Even though it came after the failed Articles of Confederation to give the national government more, not less power. Don't believe the propaganda. Read the document itself.

Today someone posted a clip from the Senate hearings to confirm (or not) Neil Gorsuch to the Supreme Court. Senator Sasse of Nebraska set him up for this "negative" document thing.



So I had to respond:

My Declaration of Opposition to Trump

States Rights has given us Slavery along with the 3/5 Compromise, the Electoral College, and Two Senators for every State. This resulted in the Civil War, Jim Crow, Segregation, and now, Donald Trump. As Joseph Smith said [paraphrased] States Rights Stink!

Slavery and the 3/5 Compromise have been banned and repealed by Amendments to the Constitution. Since the 17th Amendment, Senators are at least directly elected by the people of the states rather than the State Legislatures (thank Heavens!) The Electoral College serves no purpose if not needed to protect Slavery [thank Heavens again!]. There was some talk by the Founders that it would serve as a check to the election of a demagogue. 2016 establishes the failure of that idea with the irrationality of the faithless electors of 2016 who demonstrated no coherent plan to stop a demagogue.

Trump lost the popular vote by 2.8 million votes. That is significant. He is to be sworn in as president because of a modest win in the Electoral College after a huge loss in the popular vote. He is not our first president to do so. But the popular vote loss is embarrassing to him as no strong third or fourth party made him a plurality winner as happened in 1992 with Bill Clinton or in 1860 with Lincoln among numerous candidates receiving electoral votes. Trump lost the popular vote to Hillary Clinton. I'm no big fan of Hillary, but her indiscretions pale in comparison to Trump.

Disappointed that my regular Friday-lunch, co-worker friend was not around today, I hoofed it up to Jimmy John's for my usual No. 5. Walking back to the Federal Building, I got in an elevator with some already aboard. I pushed No. 6 and it didn't light up so the man in the corner pushed it again, being nice, I guess. Had he spent more time in the Federal Building, he would know that Elevator No. 1 doesn't light up for floor No. 6 on the left of the door, but it does on the right. Maybe the guy will get a clue and raise an issue with GSA or stop defunding the government or . . . Wait! That's Senator Lee!

Utah Can Save a Lot of Money Letting the Bundy Trials Test Ownership of Public Lands

Yes! Governor Gary Herbert and especially, legislator/lobbyist Ken Ivory take note! The State of Utah is seriously considering a lawsuit to challenge United States ownership of the federal public lands within the state of Utah based on some tricky readings of the U.S. Constitution, the Utah Enabling Act, and the Utah State Constitution - basically the same theories that the Bundy Bunch have used to claim the feds have no authority in Oregon and Nevada!

But wait! Please! A major part of the charges filed today against accused co-conspirator Cliven Bundy in armed confrontation with federal officials performing federal activities on federal public lands is that those lands were obtained by the United States under the 1848 Treaty of Guadalupe Hidalgo with Mexico and never relinquished!

US Supreme Court Says Federal Government Can Manage Public Lands

Yeah, so I'm back for another little Civics lesson. The U.S. Supreme Court ruled 40 years ago that the U.S. Department of Interior can manage the public lands in any state under constitutional federal law.

I know, the far right-wing constitutional fundamentalists don't even believe that the Supreme Court can interpret the Constitution. But better them than a bunch of cowboys with guns who forgot a change of underwear  . . . and snacks. (I'm pretty sure the US Supreme Court always has clean underwear except for maybe one or two of them. And I think they have snacks in the robing room).

The case is Kleppe v. New Mexico (1976) ruling that the Wild Free-roaming Horse and Burro Act is constitutional. We usually call it "the Wild Horse Act." We don't deal with too many burros in Utah. And it's one of those lovely Acts of Congress that they give us to manage that is absolutely impossible to manage. We are authorized to kill horses, but do you think that's the PC thing to do? And I've even been sued in my own name once as part of an alleged conspiracy to obstruct the act. The US Attorney easily got the individual names switched out for the United States as we were within our official duties; then got the case dismissed. Slam dunk.

Constitution-Choosing and the Red Ghost of Skousen

You may notice that the copy of the Constitution on the left is the one seen recently in the pockets of several of the armed occupiers of the Malheur Wildlife Refuge. The one on the right is the edition published by the Government Printing Office [now, Government Publishing Office] and is available for free from any Senator or Congressman's Office. When I get them, it's usually a handful at a time as I'm going off to share and teach Scouts the non-Skousenite doctrines of the Supremacy Clause, the 2nd Property Clause in Article IV, and the Fourteenth Amendment (among more of the basics). They both seem to be accurate copies of the Constitution as Amazon advertises the one on the left:

"proofed word for word against the original Constitution housed in the Archives in Washington, D.C."

What Amazon does not tell you, unless you read far down into the less favorable reviews, is that the one on the left includes commentary and selective quotes from the Founding Fathers in support of the extreme, right-wing agenda of the publisher, the National Center for Constitutional Studies, successor in interest to W. Cleon Skousen's Freemen's Institute. There are even ads in the back for more publications of the NCCS.

The Smaller the Government, the Muddier It Gets

There is a general belief that the smaller the government, the better. That is, unless you've ever been to an actual city council meeting or . . . let a bunch of dopey cowboys run a national wildlife refuge just for the heck of it.

Somebody thought it a good idea at Malheur to take a government bulldozer on their own authority and plow a new road through a formerly protected cultural resources site that had not been fully examined but is known to have significance to the local Malheur Paiutes who have, until armed yokels took over, had a pretty good working relationship with the federal government at the Refuge.

I'm no fan of the cumbersome bureaucracy of the federal government, believe you me. But it is a living as we try to sort out the laws and rules designed to give every participant a say and a fair shake in determining how the slow wheels of government grind ever so slowly forward, hopefully for the best. And there are many adequate opportunities for course correction through public participation in advisory councils, public rule-making, and Congressional action reflecting and balancing the interests of numerous constituents and their various group interests. Also, the President can act attempting to implement (or not) the Congressional mandates, with the Courts always available to hear challenges to the processes and decisions.

Original Intent and Original Witnesses

Apologies for borderline apologetics here, but I was cruising the interwebs and came across a very basic and forehead-slapping idea:

When it comes to the Book of Mormon witnesses, the question is which historical documents is one willing to trust? Those whose faith has been deeply shaken sometimes find it easier to trust lesser evidence rather than the best sources or the overwhelming preponderance of the evidence. But that choice is not a foregone conclusion. It is neither inevitable nor irreversible. . . . Why not opt to believe in the direct statements of the witnesses and their demonstrably lifelong commitments to the Book of Mormon? This choice asks us to have faith in the marvelous, the possibility of angels, spiritual eyes, miraculous translation, and gold plates, but it does not require us to discount the historical record or create hypothetical ways to reconcile the compelling Book of Mormon witnesses with our own skepticism.

Of course! Just like the original intent of the U.S. Constitution is set out up front, loud and clear in the Preamble and does not require us to go digging deep into 18th Century word analysis of the Federalist Papers or some off-hand remark made by one of the founding fathers to a drinking buddy at the local tavern, we need look no further than the published testimonies of the witnesses to the Book of Mormon, including Joseph himself, for an explanation of its origins.

My 31st Anniversary with the Feds

Only today did I realize that my bureaucratically formulated service computation date falls on the same day as Lincoln's Second Inaugural Address! March 4! Lincoln's address was 150 years ago today! Glad to be working for the same government of, by, and for the people. (My actual first day was May 31, 1983).

We've got a long way to go, Mr. Lincoln. The peoples' power of self-government has been vastly eroded by corporate financial power that tends to write its own rules, regulations, and laws. There are many perverse philosophies abroad in the land to tear at the fabric of the Constitution. (Many funded by the corporate financial power). But you know all about that in your tight-rope walk at the most dangerous hour of our Constitutional survival. Your actions weren't perfect, but they accomplished great good in destroying the cancer of America and its Constitution - the right of property to own humans in bondage. Thank heavens that's gone!

It has been entertaining to see the right-wing go after the Pope, of all people. I mean, if Rush Limbaugh and Glenn Beck are all against the guy for his views on Capitalism and the Social Gospel, almost they persuade me to become a Catholic! Except that if anyone really reads the Book of Mormon, the revelations of Joseph Smith, or teachings of Brigham Young, they wouldn't be a Capitalist either. It's only the Anti-Christs in the Book of Mormon who preach that each man prospers according to his own genius!

America's Original Sin

What do you see?
Race? Racist? or the President?

The original intent of the Founders was that "all men are created equal." They certainly had a problem with that in reality. The Thirteenth, Fourteenth, and Fifteenth Amendments did not fully resolve their problem. Why do we still have a problem with race? Some of you may even think I'm the racist just for bringing it up!

A while back, a relative with whom I haven't had much contact over the years took some offense at my positive opinions about and defense of President Obama. Never had this relative seen such division in America "caused by President Obama!" I tried to understand the sentiment, but we mutually agreed to disagree and the parting words from my relative were, "We don't have to talk politics, but we'll always share blood and that's more important to me than to win."

That really bothered me. But I left it alone, not because I share the view that our shared blood is more important than any political "win," but because I didn't want to go to that place where those sentiments came from. I think I do understand. After all, we are related.

I have my Cheese Nips and Diet Coke supplies. My UofU boy went off to his game-day activities. My Viewmont (BYU fan) boys are going off with the marching band competition soon to be followed by their mom as the uniform mom. I already took the old, Dodge van to Jiffy Lube so I did a Saturday chore if anyone is keeping points (apparently not). I saw the Jiffy-Lubers struggling to open the side, sliding door. I told them, "Don't open that door. If you do, it won't go back on." They gave up on it. The green van looks like it might keep going for a few more miles.

It's not exactly the purity (although far from me being some kind of libertine!) Rather it's the idealistic temperament we share. I feel the need to explain myself yet again, which, of course, is also part of the psychological profile.

Knights of the Errancy: A Serious If Unintended Pun

So my subconscious is working overtime. Yet it all seems to come rolling back to my common themes. I blogged on Memorial Day about the honor due our Veterans (just below). And the link to my earlier blog about good intentions even among misguided knights and kings was intentional. Thinking on my title, "Knights of the Air and Sea" I realized it sounded like "Knights of the Errancy" (not to mention that "knight" easily becomes "night,"but let's not go down that Freudian path).

This is deep inside my idealistic heart and I find it hard to explain. But it does help in the distinction to be made from misguided soldiers of good intent and those who followed orders, whatever the intent, to commit horrific crimes that they would recognize if their hearts were not completely closed.

Knights of the Air and Sea

On Memorial Day I reflect about loved ones gone and the ultimate sacrifice of our honored Veterans who died in the elusive cause of freedom and protection of their people as a community. War is horrible. And while I remain a temperate pacifist, I actually agree with Grant and Sherman that if war is necessary, then it should be total war to end the horror as soon as possible. I want none of that gentlemanly, organized slaughter where we line up across a field and take shots at the other side under European rules of "civilization.". Now we have the option of ending human life on our planet. And that has tempered the world to avoid all-out war. Yet, one day it could all end by the action of enough crazed people. It will take more than one to push enough nuclear buttons for the full effect of global annihilation.

Having contemplated the absolute horror of war and potential global destruction we see the necessity of avoiding that total war at all costs. Yet, I still find in my heart a human need to respect and honor those who served in the cause or at least the genuine and sincere intent of protection of the lives and the ideals of the people with whom they are united in the community of a nation.

Paved With Good Intentions

A lot of the things so familiar by overuse can be seen in other ways. Sometimes this gives an important meaning that is truer than the ordinary. One of these is that if the Lord looks on the heart and not the outward appearance, then it's the path to heaven, not hell, that is paved with good intentions.

Of course we can't just sit around only "intending" to do good. The point here is that we will usually fail in our attempts, but if we try and our heart is right, then it doesn't matter that we fail or how wrong we are.
